Definitions
1. Short
Title, extent and commencement.-
- These Rules may be called `The Punjab Law Colleges Rules
2004'.
- They shall apply to all the Punjab Law Colleges.
- They shall come into force at once, and all the previous
rules and regulations, to the extent of repugnancy, shall
stand superseded.
2.
Definitions.-
In these Rules, unless
the context otherwise requires, the following expressions have
the meanings hereby respectively assigned to them, that is to
say -
(a)`Books' include any other
material which may be issued to the students;
(b) `Classes' include lectures,
tutorials, seminars, discussions, law moots duly notified by
the College to be held during an academic year; but, does not
include participation in any extra-curricular activities, including
sports and debates;
(c) `College' means any of
the Punjab Law Colleges;
(d) `Dues' include fees,
funds, fines, and any other sum payable to the College;
(e) `Misconduct' means any
act which is pernicious or detrimental to the academic and administrative
ambience of the College, and includes -
* indulgence in activities
which the Principal considers to be subversive or undesirable,
or which militate against the decorum, composure and dignity
of the College;
* involvement in any type
of political activity in or around the College premises and
the formation of, or association with, any group or union,
by whatever name it is called;
* creating or causing
disturbance or annoyance in the classes or in or around the
College;
* damaging or attempting
to damage the property of the College in any manner whatsoever;
* disobeying any lawful
orders/instructions of a member of the Faculty, or obstructing
him in the performance of his duties, or insulting, disreputing,
or embarrassing him;
* loitering about or sitting
outside a class while the class is being held;
* involvement in an activity
which is against the norms and socio-religious traditions
of the society or which is immoral;
* inappropriate or offensive
conduct in any class or at any functions or any other activity
arranged by or under the aegis of the College;
* violation of the College rules and regulations and the orders
issued by or under the authority of the Principal or the Dean;
* tampering with the attendance
sheets/registers, or marking or getting marked feigned attendance;
and
* any other act, which
in the opinion of the Principal or the Dean, constitutes `misconduct';
(f) `Notified' means notified
on the College Notice Board, or in such other manner as the Principal
may determine;
(g) `Principal' means the Principal
of the College and includes any person for the time being acting
as Principal;
(h) `Rules' means these rules
and include regulations, orders or instructions issued, from time
to time by the College authorities; and
(i) `University' means University
of the Punjab.
Procedure
of Admission
3. Eligibility.-
- The candidates, male or female, who fulfil
the requirements prescribed by the University and the conditions
mentioned in these Rules/Prospectus are eligible for admission.
- The selection of candidates for admission
shall be on merit, determined on the basis of the marks obtained
in the last examination, written test or interview or both,
and such other factors as the Principal may determine or take
into consideration.
- Preference in the evening classes shall
be given to those candidates who are in public or private
service, or who are engaged in some profession, business or
calling.
4. Minimum Qualification.-
- The minimum qualification for admission into LL.B-I class
shall be B.A/B.Sc/B.Com or an equivalent qualification from
any recognized University.
- Admission into LL.B-II and LL.B-III classes shall be open
to the students who are qualified for admission under the
`Admission Policy' of the University.
- Students are promoted to the next class immediately after
the completion of the University examination; and, for the
purpose, they are required to get themselves enrolled for
the next class by depositing the requisite dues within the
time notified by the College.
5. Bar to Admission.-
A student who is expelled,
rusticated or whose entry is banned by any University or by any
other College or Institution for any reason whatsoever at any
time during his academic career, shall not be eligible for admission.
6. Admission Forms.-
- An application for admission shall be made on the prescribed
Form, annexed to the Prospectus which may be obtained on payment
from the College office during office hours.
- The Prospectus/Forms may also be sent by post to a candidate,
on receipt of the requisite cost and the postal charges, through
a money order or a Bank draft; however, the time consumed
in the postal transit shall not be taken into account for
purposes of the closing date.
7. Documents etc.-
- The Admission Form shall be filled in
by the candidate in his own hand, and shall be signed by him
as well as his parent/guardian.
- Attested copies of the following documents
shall be annexed with the Form -
-
(a) a certificate of good
character, signed by the Principal/Head of the educational
Institution last attended;
(b) a certificate of good
character signed by a Magistrate of the District in which
the candidate ordinarily resides, in case he graduated as
a private student;
(c) Matriculation and
Intermediate certificates;
(d) the detailed marks
certificate of the Degree examination;
(e) the certificate of
domicile;
(f) National Identity
Card of the candidate himself and of the Father/Guardian;
and
(g) in case the applicant
is in service, a certificate indicating that he has been permitted
by the Head of the Department to join the College or that
he has been or will be granted leave for the teaching session.
3. One photograph (3x3 cm)
will be pasted at the appropriate place on the Form, and four
photographs of the same size will be annexed to the application.
4. In case a candidate is a
Graduate of a University other than the University of the Punjab,
a migration certificate, in original, will be submitted along
with the application.
8. Verification of
Documents.-
- The verification of documents is a necessary condition
for admission.
- A candidate may present original documents to the person
notified by the Principal for verification of the copies of
the documents mentioned in rule 7.
- The verification shall be made on `first come first served'
basis on all working days from 9.00 am to 12.30 pm, and from
3.00 to 5.00 pm.
9. Applications for
Admission.-
- Applications for admission shall be received in the College
office on all working days from 9.00 am to 1.00 pm, and from
2.30 to 5.00 pm, against an acknowledgement.
- Applications received after the closing date may not be
entertained.
- Incomplete applications, or applications otherwise than
on the prescribed Form, or applications without duly verified
documents, or applications having any other or defect may
be rejected; provided that the Principal may, in his discretion,
allow a candidate to rectify the defect or to provide documents
within the time allowed to him.
- Whether or not an application for admission is accepted,
the application and the documents/photographs shall neither
be returned, nor copies thereof shall be supplied by the College.
10. Admission.-
- No one shall be admitted into a class after the expiry
of one calendar month from the last date prescribed for admission
or an earlier date notified by the College.
- The deposit of the admission Form/dues do not per se constitute
admission.
- The Principal may finally grant admission, or refuse admission
without assigning any reasons.
- The names of the candidates accepted for admission shall
be notified, and such candidates shall pay the dues within
the prescribed time, failing which the acceptance for admission
is liable to be cancelled without notice.
- The acceptance for admission is also liable to be cancelled
in case a candidate fails to rectify the defect or provide
the requisite documents within the time allowed to him in
terms of sub-rule (3) of rule 9.
11. False information
etc.-
- The admission secured by providing wrong information, forged
documents or concealment of relevant information shall be
cancelled, and the dues paid, forfeited.
- Notwithstanding action under sub-rule (1), the Principal
may also refer the case to the Police or any other competent
authority.
12. Change of Name.-
Ordinarily, no request for
change of name shall be entertained after admission.
Payment
of Dues
13. Fee Package.-
The Fee Package given in the
Prospectus includes Briefing session (if any), Mid-Term and Final-Term
Examinations, Special Tutorials, Seminars, Law Moots, Revision
Workshops, Visits to Courts, and Special Courses, if any.
14. Dues and Re-admission.-
- The dues are payable in advance by such dates and in such
manner as may be notified.
- Subject to any other decision of the College authorities,
the first instalment is payable at the time of admission;
the second, in the first week of December; the third, in the
second week of February, and the last, in the second week
of April.
- After the expiry of the due date for payment of the dues,
a fine of Rs.20/- per day will be charged up to the last working
day of the month, whereafter the name of the defaulting student
will automatically stand struck off the college rolls, and,
unless re-admitted, he will not be allowed to attend any classes,
or benefit himself from any other facilities at the College.
- The defaulter may, within 10 days from the day his name
is so struck off, apply for re-admission, specifying reasons
for non-payment of dues within the prescribed time.
- The Principal, in his discretion, may re-admit him on payment
of the outstanding dues and the re-admission fee of Rs.3000/-.
- The dues, once paid, are not refundable or transferable
on any account whatsoever.
15. Discontinuance
of Studies.-
A student who intends to discontinue
his studies shall make an application to the Principal for withdrawal
by the last date of the month, failing which he shall be liable
to pay the dues for the following month.
Attendance
16. Minimum Requirement.-
Every student is required to attend at least 66% of the classes.
17. Dress and Punctuality.-
- Students are required to be suitably dressed for the classes.
- Students are required to come for their classes on time,
and a late-comer may be marked as absent for purposes of that
class.
- No student shall leave the class room until the class concludes;
but, in case of grave emergency, a student may seek the permission
of the concerned teacher to leave the class; otherwise, he
will be marked absent.
- A fine of Rs.5/- per period, and Rs.10/- per day will be
imposed for absence without prior leave.
18. Dropping of a Student.-
- The Principal may drop any student from the rolls of the
College if he, without reasonable cause to the satisfaction
of the Principal, does not attend at least 50% of the classes
in any month.
- A student who, without sanction of leave, remains absent
for a continuous period of 10 days, excluding holidays, shall
automatically stand dropped on the 11th day.
- The student who is dropped under the sub-rule (1) or sub-rule
(2) may, within 7 days from the day his name is struck off
the college rolls, apply for re-admission, specifying reasons
for absence.
- The Principal, if the circumstances so justify, may re-admit
a student on payment of the outstanding dues, if any, and
the re-admission fee of Rs.3000/-.
19. Withholding of
Forms.-
The College may withhold the
`University Examination Form' of a student, for reasons of poor
attendance, or disciplinary action against him, or non-appearance/failure
in the `College Send-up Examination', or non-payment of the outstanding
dues, or for any other reasonable cause.
Law
Moots and Visit to Courts
20. Schedule of Law
Moots.-
- As soon as may be, the Dean, and in his absence the Principal,
will constitute a Law Moot Committee.
- The committee, within 15 days from the inception of an academic
year, will draw up a schedule for the conduct of -
(a) the regular law moots
during the academic year; and
(b) `Barrister Jinnah
Prize Moot' near the conclusion of the said year.
- The committee may also propose `Special Law Moots' on current
topics.
- The Committee will nominate a teacher-in-charge and, in
consultation with the said teacher, firm up `a proposition'
for every law moot.
- The teacher-in-charge and the Committee will ensure that
the proposition to be argued is reasonably debatable on both
sides, and the facts are fully set out.
- The Committee will submit its proposal to the Dean, or as
the case may be, the Principal, for approval.
- The Committee shall make necessary arrangements for the
conduct of Special Law Moots and Barrister Jinnah Prize Moot.
- The person presiding a Law Moot will announce the date and
time of, and the proposition as well as the names of the Speakers
for, the next Moot.
21. Conduct and Participants.-
- For each Moot, the committee, on the recommendation of the
teacher-in-charge, will select three to four speakers on either
side.
- Except in the case of special Moots and the Barrister Jinnah
Law Moot, the Speakers will ordinarily be chosen by rotation
so as to afford opportunity to speak to the maximum number of
students.
- Every Speaker will be allowed to present his case fully,
and the opener will have a right of reply.
- The teacher-in-charge will extend due assistance/guidance
to the students preparing a Law Moot.
- The Speakers will bring trays containing Law Reports and
other books for citation at a Moot.
- The Speakers at the Barrister Jinnah Prize Moot or any other
Special Law Moot will attend the Moot in lawyers' gowns.
22. Barrister Jinnah Prize Moot.-
- There shall be an annual competition Moot called `Barrister
Jinnah Prize Moot'.
- The competitors for the said Moot shall be selected from
amongst those who have obtained distinction in the ordinary
as well as Special Law Moots during an academic year.
23. Attendance.-
-
Attendance at -
(a) a regular Law Moot is compulsory
for the students of the class for which the Moot is arranged;
(b) a Special Law Moot is compulsory
for all the students who are notified to attend; and
(c) the Barrister Jinnah Prize Moot
shall be mandatory for all the students.
- Attendance at an ordinary Law Moot shall count as two lectures,
and attendance at a Special Law Moot or Barrister Jinnah Prize
Moot shall count as three lectures.
- For purposes of sub-rule (2), the Roll calls shall be taken
at the commencement as well as immediately before the conclusion
of every Moot; and, the credit for attendance will be given
to such students as have been present throughout the Moot.
24. Absence of Speakers.-
- The person presiding a Moot will report to the Dean/Principal
the names of the Speakers -
(a) who do not turn up at the Moot; or
(b) who were unprepared or who got less than 20 per cent marks
at a Moot.
- The Speakers mentioned in sub-rule (1) shall be liable
to such fine or such other action as the Dean/Principal may
determine in the light of the circumstances involving each
case, and the Speakers mentioned at (b) shall also be deemed
to be absent.
25. Visits to Courts etc.-
- The Moot Committee shall arrange visits
to the High Court and other Courts in small batches of students.
- The visit shall be conducted under the
supervision of a teacher-in-charge, nominated by the Committee.
- Every student visiting a court shall take
notes of the hearing of the case(s) he attends, and shall submit
a Report of the hearing to the Dean, and in his absence to the
Principal, through the teacher-in-charge, for evaluation.
- The Report shall inter alia contain the
point(s) at issue, the position taken by the parties, the comments,
if any, of the Presiding Judge, and the analysis of the case
by the student.
- The selected Reports may be published in
the College Magazine.
- At the close of an academic year, the Reports
shall be evaluated separately for each Part of LL.B., and the
best Report in respect of each of Parts shall be awarded such
prize as may be determined by the College authorities.
Scholarships/Fee
Concession
26. Grant.-
A scholarship, prize, or fee
concession cannot be claimed as a right, and is awarded at the
discretion of the College authorities, and may be withdrawn at
any time.
27. Scholarships etc.-
The College may, from time
to time, offer assorted scholarships, and other incentives on
such terms and conditions as it may determine.
28. Application for
Scholarship.-
A candidate desirous of seeking
scholarship, will apply on the prescribed `Scholarship Application
Form', along with the Admission Form, and no request for the purpose
will be entertained at any subsequent stage.
29. Fee Concession.-
-
A candidate desirous of seeking fee concession,
may apply on the prescribed `Fee Concession Application Form',
along with the Admission Form, and no request for the purpose
will be entertained at any subsequent stage.
-
All cases of fee concession will be considered
on `performance-cum-need' basis and subject to such terms
and conditions as may be prescribed, or as the Principal may
determine in each case.
30. Withdrawal of Scholarship,
Fee Concession etc.-
Subject to rule 26, a scholarship,
other incentive, or fee concession may, at any time, be withdrawn
-
(a) if the student fails to
maintain the requisite standard of attendance/performance;
(b) if the basis of the grant
of scholarship, incentive or fee concession is found forged or
fraudulent; or, if it ceases to exist;
(c) if the student does not
fulfil the conditions assigned to the scholarship, incentive or
fee concession;
(d) if he is guilty of `misconduct',
or, if he violates any rules, regulations, order or instructions;
or
(e) if his conduct and behaviour
have otherwise been unsuitable or objectionable.
Library
31. Borrowing of Books.-
-
Students may borrow books from the Library,
except Reference Books, magazines and the other reading material,
classified as Reference material.
-
A student may borrow two books at a time
for a maximum period of 14 days, including holidays; however,
if so required, any book may be issued for a shorter period,
or it may be recalled earlier at short notice.
32. Liability of the
Borrower.-
- The borrower will ensure that the book he is borrowing
is in a good condition, and will be responsible to return
the book in the same good condition.
- The borrower will not mark or underline the book in his
possession; and, will not deform or mutilate its original
condition in any manner whatsoever.
- The borrower will be liable -
(a) to bear the cost incurred on the restoration of the book,
in case the damage is reparable; and
(b) to provide its replacement from the market, or pay the
current market price of the book, in case the damage is irreparable,
or the book has been lost.
- In case a book has been irreparably damaged or lost and
a replacement is not readily available, the borrower shall
pay such amount, not less than double the purchase price,
as the Principal may determine.
33. Library Card.-
- A Library Card is issued at the commencement of an academic
year to every student of the College.
- Books shall not be issued to any other person except the
student in whose name the card stands.
- The Library card will be presented to the Library staff
for endorsement at the time of borrowing or returning the
library books.
- The borrower shall sign the relevant column of the `Borrowing
Register' in token of having received the book(s), and while
returning the book(s) he will ensure that necessary endorsement
has been made on the library card.
- The Library card must be kept in safe custody; however,
in case a card is lost, a duplicate card may be issued on
payment of Rs.30, the deposit of a photograph, and the return
of the books outstanding against the card lost.
34. Return of the Books.-
- The books must be returned as early as possible, and in
any case, within the time fixed.
- A fine of Rs.10/- per day shall be charged after the due
date.
- A student may request for re-issuance of any book, and
the book may be re-issued to him for a period not exceeding
7 days at a time, in case it is not required in the Library
for any other student or otherwise.
Conduct
and Discipline
35. Responsibility
of Students.-
-
Students will maintain a healthy academic
environment on the Campus; and, will extend due respect to
the Faculty and other staff of the College as well as to the
fellow students.
-
Students will preserve complete discipline
and decorum, and will not, directly or indirectly, indulge
in activities which tantamount to misconduct.
-
Without generality to the foregoing provisions,
students shall not indulge in activities -
(a) which are of political nature, or
which are subversive or undesirable or which tantamount
to misconduct or misbehaviour, or which militate against
the decorum, composure and dignity of the College; or
(b) which are likely to be disruptive,
distressing, disturbing, or annoying in any class or in
or around the College, or at any functions or any other
activity arranged by or under the aegis of the College;
or
(c) which tend to militate against
the sound academic or administrative discipline; or
(d) which tantamount to disobeying
any lawful orders/instructions of a member of the
Faculty, or obstructing him in the performance of
his duties, or insulting, disreputing, or embarrassing
him;
(e) which are against the norms
and socio-religious traditions of the society or
which are immoral;
(f) which tantamount to violating
the rules, regulations and orders issued by or
under the authority of the Principal or the Dean;
(g) which involves tampering
with the attendance sheets/registers, or marking
or getting marked feigned attendance; or
(h) which, in the opinion
of the Principal, are indecent, objectionable,
improper, or otherwise unsuitable at the College.
-
Students will not talk
near the lecture rooms/offices or, create
any type of nuisance, or loiter about in
or around the College.
-
Unless otherwise required, students will
leave the College premises as soon as the classes on a day
conclude.
-
The students who wish to stay for library
study shall confine themselves to the Library premises.
- Girl students shall wait for the transport in the Girls'
Common Room.
-
Students will observe/preserve the socio-religious
traditions, especially with reference to their general conduct,
action, behaviour and posture, as well as their dress.
36. Display of Identity
Cards.-
-
Students will display their identity cards
at all times they are at the Campus.
-
Students who do not so display the cards
may not be allowed to enter or stay in the College or attend
the classes.
-
The loss of the identity card shall at
once be reported to the College as well as to the Police.
-
A duplicate identity card may be issued
on payment of Rs.100/-.
37. Communication with
the College Office.-
Students will not enter the
College office-rooms, and will communicate through the windows
specified for the purpose.
38. Smoking Prohibited.-
Smoking, in or around the College
premises, is strictly prohibited.
39. Mobile Phones Prohibited.-
- As far as possible, students will not carry mobile phones
in the College; and, in any case, mobile phones shall be kept
switched off and shall not be used within the College premises.
- The teachers shall not use mobile phones while taking classes,
or tutorials, or while they are in the Library, or the reading
room, or in the office of the Dean or the Principal.
- The students who violate the provisions of this rule are
liable to such punishment, including fine, suspension from
classes or expulsion from the College, as the Principal, keeping
in view the gravity of the offence, may award, and the mobile
phone may be forfeited for such period as the Principal may
decide.
40. Display of Notices
etc Prohibited.-
- Without prior permission of the Principal, students will
not prepare, distribute, paste, exhibit or display any poster,
leaflet, notice, pamphlet or handbill in or outside the College
premises.
- An application for the purpose may be submitted to the College
office, along with a copy of the matter in respect of which
the permission is sought.
- The College office will communicate the decision to the applicant.
41. Communication of
Problems/Complaints.-
-
A student, who desires to bring anything
to the notice of the Dean or the Principal, may leave an application,
in cover, in the College Office, against an acknowledgement.
-
The College office shall obtain orders
of the competent authority, and inform the applicant accordingly.
-
Any communication or complaint to any
authority other than the College authorities, will also be
deposited in the College office for appropriate action, including
its transmission to the concerned authority, if necessary.
-
In case the complaint/information is of
secret nature, it may be brought to the notice of the Dean
or the Principal verbally during the prescribed visiting hours.
-
Students desirous of meeting the Tutor
or the Dean or the Principal must do so individually..
Miscellaneous
42. Character and Other
Certificates.-
Applications for character
and other certificates shall be addressed to the Principal and
shall be deposited in the College office. Certificates will ordinarily
be available for collection the next day, if the application is
submitted by 11.00 am on any working day.
43. Private Calls.-
- Private telephone calls of the students are not entertained,
and the College authorities do not accept any responsibility
in this behalf.
- An emergency message may be conveyed to the student concerned,
if he is available in the College.
44. Mail and Other
Valuables.-
The College will not be responsible
for the loss of any mail/valuable sent to students at the College
address.
45. Parking.-
-
Parking of vehicles within the Campus is
prohibited.
-
Students shall park their bicycles, motorcycles
or cars at the place specified for the purpose, and shall
secure their bicycles/motor cycles with an additional lock.
-
Parking is at owner's risk, and the College
authorities shall not be responsible for any loss or damage
to any vehicle for any reasons whatsoever.
Penalty
and Review
46. Penalty.-
- In addition to any penalty provided elsewhere in these
rules, a student guilty of misconduct or violation of these
rules, or any regulation, orders or instructions is liable
to such penalty, including fine, suspension from classes or
expulsion from the College, as the Principal, in the circumstances
of the case, may determine.
- Notwithstanding action under sub-rule (1), if necessary,
the Principal may refer the matter to any outside authority,
including a law enforcing agency.
47. Review.-
- Ordinarily, the penalty awarded is not subject to review.
- In case, there are extenuating circumstances, a student
may, within 7 days from the imposition of the penalty, apply
for the review of the order; however, an application for the
remission of fine must be made before the dues, inclusive
of the fine, are paid.
- The application for the review should contain the detailed
reasons and the supporting documents, if any, justifying the
review of order.
- The application shall be received in the College office
against an acknowledgement.
- The Principal may pass such orders as he may deem fit,
and the decision shall be final.
- The applicant shall be informed of the decision taken by
the Principal.
General
48. Residuary Powers.-
The College authorities may,
at any time and without prior notice to the students -
(a) make, amend or vary any
rules, and such revised rules shall apply to all the existing
as well as future students;
(b) change/revise the dues
or levy other dues/charges, and the revision will apply, from
the prescribed date, to all the students who are enrolled at the
time of revision, or who join the College in future; and
(c) revise the schedule of
any class or re-arrange classes.
49. Delegation of Powers.-
The Dean or the Principal may
delegate any of his powers to any other member of the Faculty,
or any other employee of the College.
50. Operation of Rules.-
- Admission into any class of the College and continuance
in the College as a student will be subject to these rules.
- A candidate/student must sign the Admission Form after
having read and understood these rules.
- The signing and submission of the Admission Form would
mean that the candidate/student has accepted and understood
these rules, and has agreed to bind himself to them.
